Here’s what you need to know about the Motor Vehicle (Amendment) Act 2019

The Motor Vehicle (Amendment) Act 2019 came into effect on September 1, 2019. The Act was introduced to make our roads safer by implementing safe driving practices and to impose heavy fines on motorists who violate traffic rules. As per the new act, the traffic fines will increase year on year on April 1 by a certain percentage. Here’s what you need to know

Increase in Penalties

The Motor Vehicle (Amendment) Act has increased the penalty amount for traffic violations significantly. A detailed list has been given below.

Vehicle Fitness

The new act calls for automated testing of vehicles to check its roadworthiness. This will be regulated by testing agencies that issue vehicle fitness approvals. These agencies will be brought under the Motor vehicles act and the testing standards will be set accordingly.

Vehicle Recall  

The new act enables the Central Government to issue a recall of defective vehicles if the defect causes harm to the user/other road users or to the environment. In this case, the vehicle manufacturer has to:

  • Reimburse the full cost of the vehicle (or)
  • Replace the defective vehicle with another vehicle.

Driving License

The new act gives importance to the use of E-Governance. Provisions have been made to issue learners' licenses online by verifying their identity. Commercial driving licenses will be valid for 5 years as against 3 years. Differently-abled or “Divyang” will now be able to get their licenses quicker without any bottlenecks.

Road Safety Board

Under the new act, the Central Government can set up a National Road Safety Board to provide advice to the Central and State Governments on road safety, traffic management, vehicle registration, driving license and new vehicle technology.

Protection of Good Samaritan

The act focuses to protect people who offer assistance to victims of an accident from civil/criminal liabilities. The act also includes provisions for the cashless treatment of accident victims during golden hours.

Third-party Insurance

As per the new bill, the insurance claim process will be made simple and cleared within a month. The minimum compensation for a grievous injury in a hit-and-run case will be increased to Rs. 50,000/- from the existing Rs. 12,500/-. In case of death, it will be increased to Rs. 2,00,000/- from Rs. 25,000/-.
